Insurers Liable for Construction Defects

Insurance companies that issue policies to home builders when houses are being built are liable for construction defects that are discovered by subsequent owners of the homes years later. That was the decision of the Colorado Court of Appeals on Thursday. The court sided with home builder Village Homes, said attorney Brad Levin of Denver-based Roberts Levin & Patterson, which represented Village in the case.

Prior to this decision, several insurance companies had refused to pay for the defects and legal costs, - forcing home builders to pay for them, Levin said.

This decision requires that insurance companies pay the legal defense of the home builder and damage caused by defects in construction he said.
