Strengthening Penalties for the Unreasonable Conduct of an Insurance Carrier

August 28, 2008

House Bill 1407 - The new law allows policyholders to sue their insurance carrier when benefits have been unreasonably denied or delayed. Insureds can recover twice the amount of benefits that were not paid or paid late. And, they can recover attorney's fees and costs.

The new law does not apply to workers' compensation or title insurance. It applies to life, health and disability insurance, automobile insurance medical payments and uninsured motorist coverage.
